How to tell who is an independent specialist
An independent specialist is someone who is in service for themselves. An individual may be considered an independent specialist, and not covered by the ESA, when at least a few of the following uses:
- business can end the individual's contract for [employment](https://raovatonline.org/author/adelaidabar/) services, but can not discipline the person |
- the person:- has the opportunity to earn a profit and [employment](https://scientific-programs.science/wiki/User:Hosea03T367883) has a threat of losing money from the work |
- determines how, when or where the work is performed |
- chooses whether to subcontract a few of the work |

Example
Fariah works as a client service representative for a sales business. She must work Monday to Friday from 9:00 a.m. to 5:00 p.m. in the organization's office. She utilizes the service's telephones and computer systems. She is paid $25.50 per hour. Her [employment](https://homeworkout.com) agreement does not have an end date, although her company can fire or her for bad efficiency. Her work contract mentions that she is an independent professional therefore she does not receive overtime pay, [employment](http://demo.qkseo.in/profile.php?id=999872) vacation pay or public vacation pay.
Fariah believes she may really be a worker and might be entitled to overtime pay, getaway pay and public vacation pay. She files a claim with the Ministry of Labour, Immigration, Training and Skills Development.
An [employment](https://orka.org.rs) standards officer examines her claim. The officer looks at the relationship in between Fariah and the sales company and discovers that she is a staff member
It does not matter that Fariah signed the [employment](https://jandlfabricating.com) agreement specifying that she is an independent contractor since the realities show she is a worker.
The work standards officer orders the sales company to:
- pay Fariah the overtime pay, [employment](https://gertsyhr.com/employer/thehispanicamerican/) holiday pay and public vacation pay that she was entitled to as a worker. |
- orders the company to provide wage declarations and keep records |
Employee or independent specialist: Common mistaken beliefs
A person might be thought about an employee even if:
- the individual and the company concur (orally or in composing) that the person is an independent specialist. It is the relationship between the specific and the organization (or person) that matters, [employment](https://scientific-programs.science/wiki/User:MelanieShapcott) not the label that is offered to it |
- the individual:- charges the harmonized sales tax (HST). |
- sends billings to the business. |
- utilizes their own car for work functions. |

Volunteers
Volunteers are not employees under the ESA. However, the truth that somebody is called a "volunteer" does not figure out whether that person is an employee and entitled to the defenses of the ESA.
The main factors that figure out whether someone is a volunteer or a staff member are just how much:
- the organization (or [employment](https://classifieds.ocala-news.com/author/maxwelliqh) individual) gain from the individual's services. |
- the private views the arrangement as remaining in pursuit of a living. |
In family-run businesses, the question will typically be whether the person is offering services in pursuit of a living or in service of the household.
If the individual is offering services to the family, instead of services in pursuit of a living, that person is more likely to be a volunteer.
The truth that no salaries were paid does not necessarily mean that somebody is a volunteer. The truth that there was some type of payment does not always imply someone is an employee. For instance, an honorarium may have been paid, instead of incomes.
